AN ORDINANCE ADOPTING THE MUNICIPAL CODE OF THE CITY OF ELMHURST

  • BE IT ORDAINED by the City Council of the City of Elmhurst, DuPage and Cook Counties, Illinois, as follows:

    Section 1. There is hereby adopted and passed, for the general ordinances of the City of Elmhurst (the "City"), the "Elmhurst Municipal Code", as prepared by Book Publishing Company, containing the compilation of all ordinances of a permanent and general nature, together with the changes made to such ordinances at the direction of the City Council, up to and including MCO-11 -2000, as passed and approved on July 17, 2000 (hereinafter referred to as the "Code").

    Section 2. It shall be sufficient to refer to the Code, as adopted by this Ordinance, in any prosecution for the violation of any provision thereof, or in any proceeding in law or in equity; and it shall be sufficient to designate any ordinance adding to, amending, correcting or repealing all or any part or portion thereof, as an addition or amendment to, or correction or repeal of the Code. References may be made to the titles, chapters, sections, and subsections of the Code, and such references shall apply to such titles, chapters, sections and subsections as they appear in the Code.

    Section 3. Whenever a reference is made to the Code, or to any portion thereof, or to any ordinance of the City as codified in the Code, the references shall also apply to all amendments, corrections and additions which have been or are hereafter made.

    Section 4. The City hereby adopts a continuous supplement service as a perpetual method of incorporating in the Code any ordinances of a general and permanent nature which add to, correct, amend or repeal provisions of the Code as adopted by this Ordinance, which supplements shall be deemed a part of and shall be substituted for the provisions of the Code. A complete and current copy of the Code shall be maintained and made available for public inspection in the office of the City Clerk.

    Section 5. It is not intended that the Code, as adopted by this Ordinance, should include ordinances of a special nature, such as tax levy ordinances, bond ordinances, franchises, street or alley vacation ordinances, zoning ordinances for specific properties, and annexation ordinances, and such ordinances shall remain in full force and effect unless specifically repealed or amended by a provision of the Code or by ordinances subsequently adopted by the City Council.

    Section 6. Title, chapter and section headings contained in the Code, as adopted by this Ordinance, shall not be deemed to govern, limit, modify, or in any manner to affect the scope meaning or intent of the provisions of any title, chapter or section thereof.

    Section 7. The provisions of the Code, as adopted by this Ordinance, shall not in any manner affect matters of record which refer to, or are otherwise connected with ordinances which are therein specifically designated by number or otherwise, and which are included within the Code, but such references shall be construed to apply to the corresponding provisions contained within the Code. References in city forms, documents and regulations to the chapters and sections of any former version of the Elmhurst Municipal Code shall likewise be construed to apply to the corresponding provisions contained within the Code as adopted by this Ordinance. The adoption of the Code by this Ordinance shall not affect prosecutions for ordinance violations committed prior to the effective date of the Code, or the validity of any bond or cash deposit posted, filed or deposited pursuant to the requirements of any ordinance.

    Section 8. This Ordinance shall be in full force and effect after its passage and publication in pamphlet form as provided by law.

    Section 9. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed to the extent of the conflict.

    ADOPTION OF MUNICIPAL CODE
    AN ORDINANCE ADOPTING THE MUNICIPAL CODE
    OF THE CITY OF ELMHURST, ILLINOIS

    BE IT ORDAINED by the City Council of the City ofElmhurst, DuPage County, Illinois, as follows:

    Section 1. For the purpose of revising and codifying the general ordinances of the City of Elmhurst, Illinois the following Municipal Code, consisting of Chapters 1 through 51, is hereby adopted and passed as and for the general ordinances of the City of Elmhurst.

    Section 2. The provisions of the Municipal Code of Elmhurst, Illinois, herein adopted, shall be published in book form and shall take effect on June 2,1969.

    Section 3. Ordinances adopted after March 4, 1969 are not affected by the adoption of this code, but shall continue in full force and effect.

    Section 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
