Within the physical area bounded on the south by the Chicago Northwestern Railway,
bounded on the east by Kenilworth Avenue extended, bounded on the north by the north
line of Second Street, and bounded on the west by the east line of Addison Avenue,
there shall be permitted on public property the sale of wine and beer in areas designated
by the local liquor commissioner. This authority is limited to those certain dates
and times, as approved by the City Council as periods during an Elmhurst City Fair,
that wine and beer may be dispensed on public property in the area of the City as
aforesaid.
During such City Fair, wine and beer may be dispensed within the aforesaid area only
by current liquor licensees or in the alterative, and to the exclusion of current
liquor licensees, by the sponsor of the City Fair, as approved by the local liquor
commissioner, provided that no liquor license shall be issued to the City Fair sponsor
unless the sponsor shall: (a) meet all applicable requirements for Class "D" license;
and (b) exist as not-for-profit corporation under the laws of the State of Illinois.
Licensees dispensing wine and beer at the City Fair shall provide evidence of dram
shop insurance coverage, in a form and having a best rating acceptable to the City
Attorney, and with limits of not less than one million dollars ($1,000,000.00), which
coverage shall name the City, its agents, officials and employees as additional insureds.
Any and all licensees, shall agree to indemnify, defend, save and hold harmless the
City, its agents, officials and employees for any and all claims, demands, costs,
and actions at law or in equity caused by, growing out of, arising or resulting from
the sale of wine and beer during the City Fair.
