§ 38.5.27. Coordination of construction activities.
Each grantee is required to cooperate with the City and with each other to coordinate construction activities as follows:
(a)
By February 1 of each year, each grantee shall provide the City with a schedule of its proposed construction activities in, around, or that may affect the public rights-of-way.
(b)
Each grantee shall meet with the City, other grantees and users of the public rights-of-way as determined by the City to schedule and coordinate construction in the public rights-of-way.
(c)
All construction locations, activities and schedules shall be coordinated to minimize public inconvenience, disruption or damages. In the event grantees are unable to agree upon a plan to coordinate construction locations, activities and schedules, then the City shall reasonably intercede to the extent necessary to resolve the dispute, and to minimize public inconvenience, disruption and damage, giving due consideration to all relevant facts, including construction practices, safety of workers and members of the public, costs and seasonal limitations.
(d)
During the initial construction or rebuild of any cable system, each grantee shall provide the City with monthly reports of all construction and system activation. Reports shall identify the location to which service is proposed, the time at which the construction will be completed, the time for activation of the service line, the date the area has been turned over to marketing, and other information which will assist the City in determining that such grantee is extending service to the entire franchise area. After initial construction or rebuild is completed, each grantee shall provide an annual report of system construction, if any, and such grantee and the City shall meet for periodic construction conferences.
