§ 3.13. Fire Department.

  • (a)

    Creation. There is hereby created the Elmhurst Fire Department, an administrative department of the municipal government under the general supervision of the City Manager.

    (b)

    Fire Chief. There is hereby established the position of Fire Chief, an administrative officer, who shall be appointed and removed by the City Manager with the advice and consent of the City Council. Any person appointed to the rank of Fire Chief shall, during his term of office, continue to hold that rank, if any, to which he has been appointed by the Board of Fire and Police Commissioners, provided that the Fire Chief shall be entitled to and receive only that salary pertaining to the rank of Fire Chief.

    (c)

    Deputy Fire Chief. There is hereby created the position of Deputy Fire Chief, an administrative officer, whose appointment and removal shall be by the Fire Chief with the concurrence of the City Manager. The Deputy Fire Chief shall live and be domiciled within a fifteen (15) mile radius of the intersection of Schiller and York Streets, and shall be appointed from the two highest ranks of sworn personnel currently serving on the Department. Any person appointed to the rank of Deputy Fire Chief shall, during his term of office, continue to hold that rank to which he has been appointed by the Board of Fire and Police Commissioners, provided that the Deputy Fire Chief shall be entitled to and receive only that salary pertaining to the rank of Deputy Fire Chief. The Deputy Fire Chief shall perform such administrative functions as may be assigned by the Fire Chief.

    (d)

    Battalion Chief. There is hereby created the position of Battalion Chief whose appointment and removal shall be made by the Fire Chief with the concurrence of the City Manager. The first three persons appointed to the position of Battalion Chief shall be from the rank of Captain. Thereafter, persons appointed to the position of Battalion Chief shall be from the rank of Lieutenant. Battalion Chiefs, under the general supervision of the Fire Chief, shall serve as shift commanders for their assigned shift and shall perform such administrative functions as may be assigned by the Fire Chief. Any persons appointed to the position of Battalion Chief shall, during their term of office, also continue to hold that rank to which they have been appointed by the Board of Fire and Police Commissioners provided that Battalion Chiefs shall be entitled to and receive only that salary pertaining to the position of Battalion Chief.

    (e)

    Personnel. The position of Firefighter of the City is hereby created. There shall be not to exceed forty-four (44) persons appointed to the position of Firefighter with rank as follows:

    (1)

    Fire Chief;

    (2)

    Deputy Fire Chief;

    (3)

    Battalion Chief, not to exceed three;

    (4)

    Lieutenant, not to exceed six;

    (5)

    All others with rank of Firefighter.

    Effective March 4, 2003, no person shall be appointed to the rank of Captain and such rank shall be eliminated. Notwithstanding this provision, any person who has been appointed to the rank of Captain by the Board of Fire and Police Commissioners prior to March 4, 2003, shall continue to hold the rank of Captain, shall continue to be subject to the rules and regulations of Board of Fire and Police Commissioners, and shall, if removed from the position of Chief, Deputy Chief or Battalion Chief, be paid on the basis of the salary range that is set for the position of Battalion Chief.

    (f)

    Appointment. Lieutenants and Firefighters shall be appointed in accordance with the statutes and ordinances relating to the function and authority of Board of Fire and Police Commissioners and the rules and regulations of the Board of Fire and Police Commissioners.

    (g)

    Lieutenants. Lieutenants, under the general supervision of the Fire Chief and Captains, shall serve as heads of divisions, direct the activities of Firefighters and Volunteer Firefighters and perform such administrative functions as may be assigned by the Fire Chief or Captains.

    (h)

    Firefighters. Firefighters shall perform such duties as shall be necessary to extinguish fires, including the handling of hoses, axes, pikes, fire extinguishers and other equipment; they shall drive, operate and maintain fire vehicles, pumps and rescue equipment and shall otherwise assist in general rescue work; also, they shall conduct inspections of properties and otherwise implement the purposes of the Fire Prevention Code. They shall be governed in their activities by the regulations and directions of their superior officers.

    (i)

    Divisions and Sections. The Fire Chief shall create such administrative divisions or sections as he deems necessary to the functioning of the Fire Department.

    (j)

    Functions. The Fire Department shall have primary responsibility for fighting fires, executing a fire prevention program and providing general rescue and assistance services.
