Article I. General Prohibitions |
§ 5.06. Removing materials from street.
(a)
Authority Required. It shall be unlawful for any person to cut or remove any material from any street, alley, park or other public place without authority of the City.
(b)
Regulations. The City Manager shall make such regulations pertaining to the making of openings or excavations in or under the streets as are necessary to secure the health and safety of the public and such regulations, when approved by resolution of the City Council, shall constitute the standards upon which any permit required shall be issued.
(c)
Bond and Insurance. Whenever a bond or policy of insurance is called for, as a condition precedent to the granting of any permit required by this Section, such bond or policy of insurance shall be in the sum of one thousand dollars ($1,000.00) or such larger sum as the City Manager shall specify, as commensurate with risk to the permit applicant arising out of any injury to or death of members of the public or property damage which might be suffered through the negligent or wanton exercise of the privilege granted under such permit. If a bond is furnished, it shall be conditioned to save harmless the permit applicant from loss resulting from the death of, or injury to persons or damage to property which is caused, or is occasioned by the doing of the thing or the exercise of the privilege for which the permit is required. If a policy of insurance is furnished, it shall insure the permit applicant against any such loss.
