§ 51.43. Authority of police re gambling.

  • (a)

    The Chief of Police and members of the Police Department are authorized to enter any house or place referred to in Section 51.40 and to prevent any gambling and they shall be charged with the duty of seeing that persons engaged therein are prosecuted and lawfully brought before any court to answer to proper charges.

    (b)

    It shall be the duty of the Chief of Police and every member of the Police Department to seize any device, instrument or thing used for gambling or in violation of this chapter and, upon the judgment of any court of competent jurisdiction that the same were so used in violation of this chapter and that the same be confiscated, to confiscate and destroy the same. It shall be unlawful for any person to interfere with the enforcement of this section or with any policeman or officer in the performance of his duties hereunder.
